<p class="wp-block-paragraph">Chapter 58 of the Laws of 2026 was passed as part of the New York State Budget and updates the service requirements, contribution rates, and overtime ceiling for many NYCERS members.</p>

New Law Affecting Certain Tier 6 and Tier 3 22‑Year Plans


<p class="wp-block-paragraph">Retirees with questions about their Medicare Part B Reimbursement should contact the Office of Labor Relations at (212) 513-0470 or TTY (hearing impaired) at (212) 306-7753. NYCERS <strong>does not</strong> administer the payment of this refund, as it is separate from your pension payment.</p>

<h5 class="wp-block-heading">The holidays bring joy — and a rise in online scams! In 2025, U.S. online sales are expected to hit a record $1 trillion. If you’re shopping online this season, follow these tips to stay safe.</h5>



<ol class="wp-block-list">
<li><strong>Secure your mobile device. ​</strong>Keep your operating system updated and use biometrics like face or fingerprint recognition with a strong passcode for better security.</li>



<li><strong>Limit app permissions.</strong> Review and restrict app permissions to only what is necessary, and avoid sharing sensitive data like contacts or location unless essential.</li>



<li><strong>Beware of suspicious calls and texts.</strong> Don’t answer calls and texts from unknown numbers! Cybercriminals may pose as legitimate businesses to steal personal information.</li>



<li><strong>Use secure Wi-Fi for online transactions.</strong> When using public Wi-Fi, only make transactions on HTTPS sites. If it’s easy for you to join, it’s easy for cybercriminals to do so too!</li>



<li><strong>Monitor your financial accounts.</strong> Keep a close eye on your accounts for suspicious activity to stop fraud early.</li>



<li><strong>Shop responsibly.</strong>

<li>Look for “https” and a padlock icon in the web address before entering payment.</li>



<li>Go directly to retailer sites instead of clicking on links in emails or ads.</li>



<li>Verify new stores through reviews or official marketplace.</li>

<li><strong>Pay safely.</strong> Use credit cards or digital wallets for protection and set up transaction alerts to monitor suspicious activity.</li>

<p class="wp-block-paragraph">Every September, eligible retirees and beneficiaries receive a Cost-of-Living Adjustment (COLA) to their retirement allowance that is based on the Consumer Price Index (CPI).</p>



<h3 class="wp-block-heading">What is the 2025 COLA rate?</h3>



<p class="wp-block-paragraph">The 2025 Cost-of-Living Adjustment (COLA) for eligible retirees and beneficiaries is <strong>1.2%</strong>.</p>

Cost-of-Living Adjustment (COLA) – June 2025


<p class="wp-block-paragraph">Chapter 55 of the Laws of 2025 (Part VV) extends the retiree earnings limitation waiver for school employees under RSSL §§ 211 &amp; 212 by two years to June 30, 2027.</p>

2024 Annual Comprehensive Financial Report


<p class="wp-block-paragraph">NYCERS has published&nbsp;the Fire Protection Inspector (FPI) 25-Year Plan Brochures <a href="/brochure/fire-protection-inspector-25-year-retirement-plan-tier-4-members-fpi-25">#950</a> and <a href="/brochure/fire-protection-inspector-25-year-retirement-plan-tier-6-members-6fp-25">#951</a>&nbsp;for eligible Tier 4 and Tier 6 FPI Members. An FPI Member is a NYCERS member employed by the City of New York or the New York City Fire Department in a title whose duties are those of an FPI, Associate FPI, or a supervisor of those employees. <a href="https://mynycers.nycers.org/MyNYCERS/s">Log in</a> to your MyNYCERS account to view your eligibility letter and election form.</p>

Cost-of-Living Adjustment (COLA) – June 2024


<p class="wp-block-paragraph">Two new laws – Chapter 55 and Chapter 56 of the <a href="/post/2024-laws">Laws of 2024</a> – that were recently passed as part of the New York State Budget, may impact certain NYCERS members and retirees.</p>


New Laws May 2024


<p class="wp-block-paragraph">Chapter 56 of the <a href="/post/2024-laws">Laws of 2024</a>,&nbsp;effective April 20, 2024, reduces the number of years used in the Final Average Salary (FAS) calculation for certain Tier 3 and Tier 6 members who retire on or after April 20, 2024. If the law applies to you, NYCERS will automatically update your FAS calculation in our system.</p>

<p class="wp-block-paragraph">Local Law 12 of 2023 requires every New York City agency to create and publish a plan that describes their strategy to address the access needs of people&nbsp;with disabilities. The plan, known as a Five-Year Accessibility Plan, outlines the agency’s accessibility efforts in the areas of&nbsp;Digital Accessibility, Workplace Inclusion, Effective Communication, Physical Accessibility, and Programmatic Access.</p>

<p class="wp-block-paragraph">Governor Hochul recently signed into law, <a href="/post/2023-laws">eight new bills</a> related to the retirement systems’ membership. NYCERS is reviewing the specifics and will provide information shortly. Please check back for further updates.</p>

<p class="wp-block-paragraph">Chapter 782 of the Laws of 2022 amends GML section 208-f to permit the parents of a member to collect the Special Accidental Death Benefit (SADB) if the member has no spouse or child under the age of 18 (or 23 if the child is a student).</p>

<p class="wp-block-paragraph">Chapter 783 of the Laws of 2022, extends the provisions of the COVID Accidental Death Benefit for an additional two years to apply to members who died on or before December 31, 2024.</p>

WTC Filing Deadline Extended to 9/11/2026


<p class="wp-block-paragraph">This law amends the Retirement and Social Security Law (RSSL) § 361-a(c) and General Municipal Law (GML) § 208-f(c) by increasing the deceased member’s salary used in the computation of the special accidental death benefit by adding to it an additional percentage. The beneficiaries of the following NYCERS members are covered: Correction Officers, Housing and Transit Police, Uniformed Sanitation members, certain EMTs and TBTA members.</p>



<p class="wp-block-paragraph">This law is effective as of <strong>July 1, 2022</strong>.&nbsp;</p>

New Law – Chapter 528 of the Laws of 2022 – Increases certain special accidental death benefits


<p class="wp-block-paragraph">In a joint <a href="/sites/main/files/file-attachments/new_nyc_chief_actuary_announced_-_final.pdf">statement</a>, the five New York City retirement systems today announced Marek Tyszkiewicz as New York City’s new Chief Actuary. The Chief Actuary is the legally-designated technical advisor to the five Boards of Trustees, overseeing the actuarial calculations for City employees’ post-employment benefits.</p>

<p class="wp-block-paragraph">This act amends the provisions of Chapter 77 of the Laws of 2021 and extends the ability for NYC and NYS employees to get 4 (four) hours of paid leave per COVID injection to December 31, 2023.</p>

<p class="wp-block-paragraph">The New York City Department of Education did not elect to participate in the ERI by the May 31st deadline.</p>



<p class="wp-block-paragraph">The City of New York did not elect to participate in the ERI by the June 30th deadline.</p>



<p class="wp-block-paragraph">Therefore, there is no Early Retirement Incentive for DOE/City employees under Chapter 59 of the Laws of 2021.</p>

<p class="wp-block-paragraph">On April 19, 2021 Governor Cuomo signed into law Chapter 59 of the Laws of 2021, which provides the City of New York and the NY Board of Education, also known as the NYC Department of Education (DOE), the option to elect an Early Retirement Incentive (ERI).</p>

<p class="wp-block-paragraph">Chapter 78 of the Laws of 2021, which provides death benefits to statutory beneficiaries of members whose death was a result of or was contributed to by COVID-19 has been extended to members who die through December 31, 2022.</p>



<p class="wp-block-paragraph">NYCERS members who are furloughed per Mayor de Blasio’s order will not receive pay for the time they are furloughed and therefore, will not receive service credit for that time. The furloughed time cannot be bought back unless legislation is passed to permit the purchase.</p>

NYSNA Settlement


<p class="wp-block-paragraph">On March 17, 2014, a settlement between the City of New York and the United States Attorney’s Office in the case of <em>Goodman et al v. City of New York et al</em> (“Goodman”) became effective. &nbsp;</p>



<p class="wp-block-paragraph">The Goodman Settlement impacts the pension calculations of certain members and pensioners who served in the military after September 11, 2001.</p>
