Part FFF of this Budget Bill amends the Retirement and Social Security Law (RSSL) to reduce the normal retirement age of Tier 3 Uniform Sanitation and Uniform Correction 22-Year Plan members to the age they complete, or would have completed, 20 years of service.
Part FFF is effective May 26, 2026.
Part XX of this Budget Bill amends the RSSL to reduce the Basic Member Contributions (BMCs) of Tier 6 NYCERS members, except for Transit 25/55 and TBTA 20-Year Plan members, as follows:

Part XX also extends the exclusion of certain overtime and compensation wages from the annual wage calculations used to determine the member’s salary band through January 1, 2029.
Furthermore, Part XX increases the Tier 6 Overtime Ceiling to $30,000 for Calendar Year 2027 and increases the ceiling by 3% each subsequent year.
Part XX is effective May 26, 2026,however, the change in BMC rates become effective October 1, 2026 and the Tier 6 Overtime Ceiling increase becomes effective January 1, 2027.

Transit 25/55 and TBTA 20-Year Plan members are not eligible to receive a reduction in their Basic Member Contribution (BMC) rate.
If you are eligible for a reduction in your contribution rate, NYCERS will automatically update your pension account with the new BMC rate by October 1. You will also receive a letter from NYCERS in October – either in your MyNYCERS account or via USPS mail (depending on your contact preference) – with details about the rate change.
If you are not eligible for a rate reduction, you will not receive a letter.
The rate change will not affect your affect your retirement application or service calculation.
Yes. Tier 6 members who leave City service with less than 10 years of NYCERS membership may file for a refund of member contributions by filing the Application for Refund of Member’s Accumulated Salary Deductions, Form #331. Form #331 can also be submitted online by logging in to MyNYCERS and selecting “Refund” from the left navigation menu; Members with five years but less than 10 years of NYCERS membership are required to include the Waiver of Right to a Vested Retirement, Form #341, to waive their right to a future vested benefit.
